In addition to our privacy policy, the following terms and conditions listed below also apply to you as a Party Spirit customer. When you purchase from Party Spirit, you are entering into a contract with us to which these terms and conditions apply, setting out our obligations to you.
Party Spirit is a sole proprietorship in Wädenswil ZH, Switzerland.
The following terms and conditions have been established in accordance with applicable Swiss law. The place for the resolution of any disputes that may arise is, unless otherwise provided by law, the place of the registered office of the company, in this case Wädenswil ZH. The parties involved in the dispute shall attempt to resolve any disagreements in good faith. All potential disputes arising from the legal relationship, excluding conflicts of law, shall be governed by Swiss law. Please note that in case of complaints or disputes, the German version of our terms and conditions will prevail.

All prices displayed on the website are payable in CHF (Swiss Francs). We reserve the right to change the prices of our products or withdraw a product from sale at any time, regardless of whether an order has been placed for the product.
Purchase completion and contract
The completion of the purchase is done through our user-friendly check-out process, where you will be asked to provide your correct information. Immediately after completing the online checkout process, you will receive a confirmation email to indicate that we have received your order. Once your order is ready to be shipped, we will send you a message about the shipment of the package. At this time, we accept your order and the sales contract is considered complete. If there is a problem in stock or payment details, or we notice an error in the price or description of the product, we reserve the right to cancel the order.
Delivery
The products ordered from Party Spirit will be delivered to the delivery address you specify in the ordering process and will be shipped within the specified time, subject to availability. Once the products are shipped, Party Spirit is deemed to have fulfilled its obligation arising from the conclusion of the purchase agreement. If there are any delays in delivery that are beyond Party Spirit’s control, Party Spirit shall not be responsible for any additional costs incurred as a result. In such a case, the customer has no right to claim compensation from Party Spirit. We recommend that you check the products when they arrive and report any complaints within 7 days by emailing info@partyspirit.ch. If the complaint is justified, Party Spirit will review the case and, if necessary, arrange for a replacement or refund of the amount paid.
Orders received Monday-Friday after 2pm, or all orders received on Saturdays, Sundays and Swiss Holidays will be processed the following business day. Estimated shipping time will be calculated from that time.
For unclaimed packages and incorrectly specified addresses, a handling fee of CHF 20 and the return fees of the post office will be charged to the customer.
Payment options
Secure Online Payments
At Party Spirit, security is our number one priority. You can buy and pay online with peace of mind because our website is up to date with the latest security for online payments. Our payments are secured through third party providers (Postfinance Checkout). Party Spirit does not store card information nor does it share it with third parties.
At checkout we offer you a choice of different payment methods, including Visa, Mastercard, PostFinance, TWINT and the system for secure online payments Paypal (www.Paypal.com). Paypal is a quick and easy form of payment that accepts most credit cards.
Prepayment by bank transfer
If you choose “bank transfer” when checking out, your order will be shipped within 24 hours after we receive your payment. If we do not receive your payment within 3 days, we reserve the right to cancel your order.

Cash payment
We are happy if you decide to pick up your purchase directly at our store in Wädenswil ZH and pay cash. Please choose the option ‘bank transfer’ at check out. Please note ‘cash payment’ in the comments and a proposed date. We will contact you via email or SMS to confirm the date or to make a new proposal. We ask that the order be received at least 2 days prior to pickup so that we can guarantee inventory. If you pick up the goods in person, the shipping costs will be waived.
Returns
Party Spirit offers high quality products at reasonable prices. If you are ever not satisfied, please email us within 7 days with the reason for return. No selection shipments will be made and only damaged or defective products will be returned and refunded. Products must be returned to us in original packaging and unopened. Please make sure that the invoice is enclosed. We will return the amount to an account at a Swiss bank or Postfinance as soon as the return shipment has been processed accordingly. Party Spirit reserves the right to cancel a purchase contract if there is a shortage of stock, if the delivery address falls outside of Party Spirit’s delivery area, or if an incorrect price is displayed due to an error. If Party Spirit is forced to cancel an order, we will refund any payments made up to that point and will not be liable for any compensation beyond that. Shipping costs will only be refunded if we have sent the wrong items.
Obligations
Party Spirit assumes no responsibility for the loss or damage caused directly or indirectly by the late or non-delivery, which are beyond the control of Party Spirit or happen through third parties.
Furthermore, Party Spirit, in full compliance with the prevailing Swiss law, is not responsible for the claims, losses or damages of any kind, unlimited, direct or indirect. Neither for damages or losses related to data, lost profits or revenues due to the use of our website.
Party Spirit will ship ordered items within 24 hours of receipt of the order and will attempt to ship on the day the order is placed, provided the order is received by 2pm. Party Spirit reserves the right to delay shipment due to extraordinary circumstances. We will contact you in such a case.
Health and safety
Toys and items that you can purchase at Party Spirit comply with European regulations for safety and usually carry the CE seal as well as a notice regarding the age of the child for which the items are intended. Please keep the packaging to have the safety instructions handy at all times. Balloon inflation should be done by adults and children under 8 should be supervised by adults when handling balloons. Toys and products may contain small parts, which are therefore not suitable for children under 36 years due to the risk of suffocation.
Customer data
From time to time we pass on the list of our customers (name and address) to third parties. This is common practice of many shipping companies and has the consequence that you will receive information for products and services that may be of interest to you. If you do not wish to receive this service, please select “No” in the newsletter subscription process.
